What is an Affirmative Action Program?

An affirmative action program (“AAP”) is a set of specific and result-oriented procedures to which an employer commits itself in good faith. The objective of these procedures is to increase the representation of classes of individuals demonstrated to be under-represented in the workplace: i.e., women, minorities, individuals with disabilities and Vietnam Era Veterans. Affirmative action, plus such efforts is equal to real employment opportunity for such individuals.

An acceptable affirmative action program must include an analysis of areas within which the employer is deficient in the utilization of minority groups and women. Further an affirmative action program includes goals and timetables to which the employer’s good faith efforts must be directed to correct any deficiencies in the representation of these groups in the workplace. Ultimately the goal of affirmative action is to achieve prompt and full utilization of minorities and women, at all levels and in all segments of its work force where deficiencies exist. Affirmative action also includes accomplishing these same goals for the handicapped, disabled veterans and Vietnam era veterans.

Affirmative action is not preferential treatment. It does not mean that unqualified persons should be hired or promoted over other people. What affirmative action does mean is that positive steps must be taken to ensure equal employment opportunity for traditionally disadvantaged groups.
